Milton, NY: Cluster Subdivision Ordinance

The Town of Milton offers an “open space incentive option” that gives the town planning board the ability to increase the maximum density in the town’s R2 zoning district.  The provision allows the planning board to increase the number of permitted residences by 50 percent on properties greater than 10 acres if 50 percent of the land become permanently protected open space.  The town makes decisions about proposals for open space initiative options based upon its own Rural Development Design Guidelines and the town’s desire to conserve open space resources, including existing farms and land suitable for agricultural use.
