Abstract:
Delaware Senate Bill 333, passed June 23, 2004, amended housing rules for land enrolled in the state's agricultural districts, which are special areas where commercial agriculture is encouraged and protected. The changes allow permitted residential units to be occupied by any person, rather than restricting residency to family members or agricultural employees. At the same time, the law reduced the total number of potential housing units per farm. In addition, it clarified several activities as permitted uses of district lands, including farm markets and roadside stands, agritourism activities, horse stabling and training, non-commercial hunting and trapping, and spray irrigation using treated wastwater on conventional cash crops. The district rules form the basis of Delaware's agricultural conservation easement restrictions.
